Introduction

This Privacy Policy describes how Prevail Venture Capital — a division of Prevail Innovative Wealth Advisors, LLC ("PIWA"), a federally registered investment adviser — collects, uses, retains, and discloses information when you visit prevailventurecapital.com or submit information through it.

Prevail Venture Capital is not directed at retail investors. Investments offered through Prevail Venture Capital Fund I, LP are limited to accredited investors and are made only through the Fund's Private Placement Memorandum. This Policy applies to anyone who visits the site or submits an inquiry through it, regardless of whether you are evaluating the Fund, a portfolio company, a partnership opportunity, or an employment opportunity.

Who we are

"Prevail," "we," and "us" in this Policy refer to:

• Prevail Innovative Wealth Advisors, LLC ("PIWA"), the federally registered investment adviser that operates Prevail Venture Capital as a division.
• Prevail Venture Capital Fund I, LP, the venture capital fund.

PIWA, Prevail Strategies, LLC (insurance), and Prevail Innovative Real Estate Opportunities, LLC have common ownership and control. References to "Prevail" in this Policy concern the entities operating prevailventurecapital.com unless context indicates otherwise.

Our principal place of business is 4745 W 136th St, Leawood, KS 66224.

Information we collect

Information you provide

When you submit the contact form, we collect the information you choose to include: your name, email address, state of residence, the nature of your inquiry (LP / investor relations, founder / pitch, press, partnerships, careers, or general), and the message body. We also record the time of submission and the IP address from which it was sent, for abuse prevention and recordkeeping.

Information collected automatically

When you visit pages on prevailventurecapital.com, our first-party analytics records the following to operate and improve the site:

• Network identifiers — your IP address and a session identifier generated locally in your browser.
• Device and environment — your user-agent string, viewport dimensions, device type (mobile, tablet, or desktop), and the language reported by your browser.
• Behavior — which pages you visit, scroll depth, dwell time on identified sections, clicks on identified elements (with their coordinates, so we can render aggregate heatmaps), referrer domain, and any utm_source, utm_medium, or utm_campaign query parameters present in the URL.
• Performance — page load timings reported by your browser (time-to-first-byte, DOMContentLoaded, largest contentful paint), used to diagnose slow pages.

We do not use Google Analytics, Meta (Facebook) Pixel, TikTok Pixel, or any third-party advertising or behavioral tracking service. All analytics data is collected directly by Prevail and stored on infrastructure we control.

Cookies and local storage

We use a small number of first-party cookies and one localStorage entry. No third-party cookies are set by this site, and no advertising cookies are used.

• _pvc_vid — a randomly generated visitor identifier, valid for one year, used to distinguish unique visitors in analytics aggregates.
• _pvc_sid — a session identifier scoped to the current browser session and cleared when the tab is closed.
• pvc_dash — set only when an administrator logs into the dashboard at /dashboard; not present for ordinary visitors.
• pvc_no_track — set when you use the per-device opt-out below. When present, all analytics collection is skipped for that browser.

How we use information

We use information collected through this site for the following purposes:

• To respond to inquiries you submit through the contact form and route them to the appropriate person on our team.
• To operate, secure, and improve the website itself — including detecting abuse, debugging errors, and understanding which content visitors find useful.
• To meet recordkeeping obligations applicable to registered investment advisers under SEC Rule 204-2 and related rules.

We do not use information collected through this website for behavioral advertising, audience modeling, lookalike targeting, or marketing personalization, and we do not sell information to advertising networks or data brokers.

When we share information

We share information only with the limited set of service providers necessary to operate the site and process inquiries:

• ActiveCampaign — when you submit the contact form, your submission is mirrored to our ActiveCampaign account so the receiving team is notified by email. ActiveCampaign acts as a service provider under our instructions.
• Cloudflare — our edge network and content delivery layer. Processes request metadata (IP, request headers, TLS state) to deliver pages and provide DDoS and abuse protection.
• Cloudflare R2 — receives continuous, encrypted backup copies of our analytics database via Litestream replication, so we can recover from a server failure.

We may disclose information when required by law, valid legal process, or to respond to a credible threat to the safety of any person.

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act ("CCPA") and analogous state privacy laws.

How long we keep information

• Contact form submissions are retained for as long as we need them to respond to your inquiry or to satisfy applicable recordkeeping requirements. We delete submissions on request, subject to those requirements.
• Raw analytics events (per-page-view rows, per-click rows, per-scroll milestone) are retained for 90 days. After 90 days, raw events are aggregated into daily summary statistics that contain no individual user details, and the raw rows are deleted automatically.
• Backup snapshots are retained for the operational period of the corresponding production data.

Your rights and choices

Depending on where you live, you may have the right to:

• Know what categories of personal information we have collected about you and how we use them.
• Request access to a copy of the personal information we hold about you.
• Request correction or deletion of that information.
• Opt out of the limited sharing described above.

To exercise any of these rights, email venture-capital@prevailiws.com with enough detail for us to identify your records. We will respond within the timeframe required by applicable law.

Universal opt-out signals. Our site honors the Global Privacy Control (GPC) signal and the legacy Do Not Track (DNT) header. If your browser is configured to send either, our analytics will not record your visit — no opt-out cookie required.

Per-device opt-out. You can also opt out directly on this device using the control below.

Children

This website is intended for adults evaluating venture capital advisory services and accredited-investor opportunities. We do not knowingly collect personal information from children under the age of 13. If you believe a child has provided information through this site, contact us at venture-capital@prevailiws.com and we will delete it.

Security

All traffic to prevailventurecapital.com is encrypted in transit using TLS, with HTTP Strict Transport Security (HSTS) enforced. Submissions and analytics are stored on infrastructure controlled by Prevail and accessible only to authorized personnel. We maintain administrative, technical, and physical safeguards designed to protect the information we hold.

No transmission over the internet or method of electronic storage is fully secure. If you believe your interaction with this site has been compromised, contact us immediately at venture-capital@prevailiws.com.

Changes to this policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be highlighted on the page and, where appropriate, communicated directly. Continued use of the site after an update constitutes acceptance of the revised Policy.
